Negligent accident benefit

This benefit is a one-off payment made to cover any losses not covered by a disability pension. There may be an entitlement to a negligent accident benefit in the following circumstances:

The insured event (occupational accident or disease) arose because of gross contravention of the health and safety regulations by a third party
The insured event has resulted in significant and persistent physical or mental impairment of the capacity of the insured person
The insured person is also entitled to claim a disability pension as a result of the insured event.

A claim under the law that applies to health and accident insurance of civil servants B-KUVG is dealt with in accordance with the provisions of the Amtshaftungsgesetz (Liability of Public Bodies’ Act).
